first off let me say thank you in advance. i have learned alot by reading all the posts and think this site is great. Hopefully someone can help me with some of my questions.

my idea is a new spin on an old toy. The toy is the magic 8 ball by mattel. its the toy that you ask it questinos and shake it up and turn it over and it gives you an answer. if you are not familiar with the toy, visit this link.

(it was patented in the 1960's, so I don't think there is patent protection)

there have been many spin offs both by mattel and others. This is a spin off I found by a company called accoutriments.

anyway, I want to create an ball with a new set of sayings. Im thinking mattel is the best place to start, but I am concerned that my idea will get bootleged. How can I protect myself? Do I need to trademark each saying?

any advice will be greatly appreciated. thank you
